Data protection statement

When using this website, we collect, process and use data. The usage and protection of data is done in line with the Personal Data Protection Law of Bosnia and Herzegovina and the General Data Protection Regulation. Website of Sarajevo Photography Festival (SPF) and Sarajevo Photo Award (SPA) may contain links to websites of other providers to which this data protection statement does not apply.

2. Collection and use of your personal data
2.1 General use of the service

When using the website, we collect and store certain data automatically. This includes: the IP address or device ID assigned to the respective end user device, which we require for the transmission of requested content (e.g. in particular content, texts, images and product information as well as files made available for download, etc.), the type of end user device, the URL of the previously visited websites, the browser type and operating system used and the date and time of use.

This data processing takes place in order to facilitate the use of the website.

We hold this information for a maximum of one month for the purpose of recognising and pursuing misuse.
Aside from this, we delete or anonymise these usage data, including the IP addresses, without undue delay as soon as they are no longer needed for the above mentioned purposes.
The processing of the data is carried out on the basis of legal provisions which authorise the data processing because it is necessary for the provision of the website to the user, or because we have a legitimate interest in safeguarding the security and functionality of our website as well as its proper use without the affected data subjects having an overriding interest.

Website of Sarajevo Photography Festival and Sarajevo Photo Award may contain links to websites of other providers to which the data protection statement does not apply.

2.2 SPA registration

When applying for the SPA, you have to state your first and last name, your date of birth, your telephone number, the link on your website, and optionally a short CV and a valid e-mail address. You also need to upload a photo series. This information is stored with your profile. The data are processed on the basis of the statutory regulations permitting data processing, because they are necessary for providing this functionality to you.
We delete these data when the SPA cycle has ended.

By paying the entry fee you agree to become a member of the Association “Friends of Art”. Your membership ends on December 31, 2024.

2.3 Consents to receive newsletter and other advertising

If you have given us your consent to receive newsletters and other promotional communications, we will use your provided data (including data you may have entered in your user account) on the basis of your consent to send you newsletters and other promotional communications – depending on the preferences you set up – by mail, by telephone or by electronic mail (e-mail, SMS, MMS, instant message).

You can withdraw you consent at any time with effect for the future by sending an E-Mail to [email protected]. The withdrawal of your consent does not affect the lawfulness of the processing based on the given consent prior to its withdrawal. If you withdraw your consent, we will no longer use your data to send you newsletters or other promotional communications.

2.4 Usage of Cookies

We use cookies to increase the functionality of our website and to simplify your visit on our website. Cookies are text files containing information. When using our website, they are stored on your end devices (computer or mobile device) and do no damage there.

Persistent cookies store information which may contain personal data from your browser. These can for example include the following information: your anonymised IP address, the type of your device, the domain, the browser type and the language used, the operating system, the county and time zone, previously visited websites or information about an interaction with our websites, such as click behaviour, purchases and preferences. The persistent cookies used on our website are subject to the additional terms of section 2.5.

The processing of the data is carried out on the basis of legal provisions which authorise the data processing because it is necessary for the intended and comprehensive provision of the website and the functionalities offered thereon.

3. Disclosure of data

A disclosure of your personal data without your express prior consent occurs, in addition to the other instances mentioned in this data protection statement, only in the following cases:

  • to criminal prosecution authorities as well as, if necessary, harmed third parties if necessary to investigate illegal or abusive use of the website. However, this only occurs if there are specific indications for illegal use or misuse. A disclosure can also take place if this serves to enforce the terms and conditions for the use of the website or other agreements or if necessary, to assert, exercise or defend legal claims. Our legitimate interest for the processing is safeguarding the proper functioning of our website and to assert, exercise or defend legal claims, as the case may be.
  • to certain governmental agencies, such as the criminal prosecution authorities, public authorities that prosecute administrative misdemeanours sanctioned with fines and the tax authorities.

4. Rights of the data subject

You have the right to obtain information at any time about the data stored about you. You may also be entitled to the following rights in case the respective requirements are met:

  • Right to rectification: You have the right to have false personal data concerning you be corrected.
  • Right to erasure: You may also request the deletion of your personal data, for example if your data are no longer required for the purposes for which they were collected or otherwise processed.
  • Right to restriction of processing: You also have the right to request that the processing of your personal data be restricted; in such a case, the data will be blocked for any processing. This right exists in particular if the accuracy of the personal data between you and us is debated.
  • Right to data portability: If we process your personal data to fulfil a contract with you or on the basis of your consent, you also have the right to receive your personal data in a structured, commonly used and machine-readable format, provided and to the extent that you have made the data available to us.

5. Deletion of data

Unless otherwise described in this data protection statement, we will only store your personal data for as long as it is necessary to achieve the purposes stated herein or within the framework of a statutory storage period; in the latter case, we will block your data for other processing.

You may also request deletion of any personal information that you have provided to us. We may not be able to delete your personal information except by also deleting your user account and Competition entry. We may not accommodate a request to change or delete information if we believe the change or deletion would violate any law or legal requirement, cause the information to be incorrect, or for other good reason permitted by applicable law.

6. Payment Processing

All our financial transactions are handled through our payment services providers Monri. We will share information with our payment services provider only to the extent necessary for the purposes of processing payments between you and CRC. These providers have their own privacy policies that will apply to your use of their service.

7. Amendments to this data protection statement

We always keep this data protection statement at the newest level. Therefore, we reserve the right to amend them from time to time and make changes when collecting, processing or using your data. The current version of the data protection statement is always available on our website.

TERMS OF USE

Sarajevo Photography Festival (SPF) and Sarajevo Photo Award (SPA)  are international annual events organised and run buy the NGO “Friends of Art” (hereinafter referred to as: the Organiser).

By browsing the website and/or entering the Sarajevo Photo Award you agree to comply with the Terms of use noted in this document entirely and without any reservation. Thereby you are agreeing to these terms and conditions which shall constitute a binding agreement between you and the Organiser.

Copyrights remain with the photographer, and any photographs used by the Organiser shall carry the photographer’s credit line. The Organiser is granted an infinite, irrevocable, perpetual, unlimited, non-exclusive, royalty-free, transferable, infinitely sub-licensable, worldwide license to publicly use, publish and promote submitted photographs for any promotional and marketing purposes related to the SPF and/or SPA without need to obtain any additional consent from the author. The Organiser may use the submitted photographs for promotional purposes on booklets, books, websites, magazines, newspapers, exhibitions, mobile media and all relevant PR campaigns, in both printed and electronic version, as well as in any other way considered appropriate. The Organiser may entitle any third-parties including but not limited to press partners, marketing platforms and affiliate websites as decided by the Organiser at its sole discretion to promote, publish or exploit your photographs without any obligations or dues towards you or to any third-parties.

Neither the Organiser nor any affiliates or partners assume any responsibility for materials submitted in violation of competition rules or for those which violate copyright regulations. By submitting photographs to the SPA, photographer guarantees that all content submitted is their own work and free of any third party rights. You warrant that you own and control all rights related to your submitted work, and that you will cooperate should there be any need to prove your ownership. Furthermore you guarantee that your submission complies with all relevant laws, and does not in any way infringe any intellectual rights or other rights, including moral rights and rights of privacy, of any third-party.

All entries must be original photographs taken by the participant, and must not have been altered or enhanced by any form of AI technology. Entries that are found to have been created using AI technology will be disqualified.


As a participant of the SPA you agree not to: publish and/or transfer legally protected content; publish and/or send profane, defamatory, pornographic, abusive, threatening, racist, fascist and chauvinistic contents, texts, images, video and/or audio files; impersonate (in the name of another person); publish, transfer and/or send information that violate any applicable laws of Bosnia and Herzegovina and/or international laws; publish, transfer and/or send false information in terms of causing damage to the other persons; spread ethnic hatred or insult citizens of Bosnia and Herzegovina or any other country along ethnic or any other base; insult other members of the Organiser; misuse the Organiser’s web site, the SPF and the SPA in any other way. The Organiser will act to maintain the integrity of the competition and its affiliated entities but is not responsible for any damages resulting from images submitted in violation of rules and regulations. You acknowledge and agree that the display or inclusion of your submitted work shall be in our sole discretion.
